§ 1 General Provisions
1. The application is owned by Milires Kamil Rączka (hereinafter referred to as the "Administrator").
2. Using the Application implies acceptance of these Terms and Conditions.
3. The Application is intended for adults and individuals capable of legal actions. The Administrator reserves the right to make changes to these Terms and Conditions.
4. The User will be informed about changes through the Application or via the email address provided by them.
5. In matters not regulated by these Terms and Conditions, the provisions of the Civil Code and the Consumer Rights Act shall apply.
§ 2 Use of the Application
1. The User is obliged to use the Application in accordance with its purpose and the law applicable in Poland.
2. The User is responsible for all content they post in the Application.
3. The Administrator is not liable for damages resulting from the use of the Application by Users, including data loss and damages resulting from technical failures.
4. The User is obliged to use the Application in accordance with its intended purpose and must not use it for purposes that are illegal or against good morals.
5. It is forbidden to post content of a pornographic nature, vulgarisms, offensive content, content promoting violence and hatred, as well as content that infringes copyright in the Application.
6. The Administrator reserves the right to remove content that is not in accordance with the Terms and Conditions and to block the account of a User who violates these provisions.
7. The Application may use cookies to improve the quality of services provided and for statistical purposes.
8. The Administrator reserves the right to suspend the provision of services through the Application for necessary technical work.
§ 3 Odpowiedzialność Administratora
1. The Administrator is not responsible for content posted by Users in the Application.
2. The Administrator is not liable for damages resulting from the use of the Application by Users.
3. The Administrator is not responsible for technical failures of the Application that prevent Users from using it.
§ 4 Privacy Protection
1. MILIRES Kamil Rączka ensures the privacy protection of application users and processes personal data in accordance with applicable legal regulations, including Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (GDPR), and the Personal Data Protection Act of 10 May 2018.
2. The Habitalize Application processes the following personal data: email address, password, data entered by the user in the application, such as goals, habits, plans.
3. User data is stored securely and is not shared with third parties unless necessary for the provision of services or in accordance with applicable legal regulations.
4. The User may at any time request the deletion of their personal data by contacting the application administrator at the email address: biuro@habitalize.com.
§ 5 Final Statements
1. MILIRES Kamil Rączka reserves the right to make changes to these Terms and Conditions, provided they do not violate the rights of application users.
2. In the event of changes to these Terms and Conditions, the user will be informed via email, as well as by publishing information on the application's website.
3. All disputes arising in connection with the use of the Habitalize application will be settled by the competent Polish courts in accordance with applicable legal provisions.
4. In matters not regulated by these Terms and Conditions, the relevant provisions of Polish law shall apply.
